  • Research

As mentioned earlier I am Jean Monnet Professor of European Law at the Faculty of Law at Lund University, Sweden. The name of my chair indicate that I have been appointed for my professorate by the European University Council and the European Commission on the application by my university in international competition. There are other Jean Monnet Professors at many other universities such as Groningen, Harvard etc. I have obtained my doctorate, LL.D., at Lund University. I achived the award of King Oscar II in 1996 for a distinguished doctoral thesis. I obtained my law degree, LL.M., in 1986 also at Lund University.

My research has mainly concerned issues related to free movement. My doctoral thesis concerned the delimitation between Community concerns and national concerns in the field of free movement of goods. I have also written a textbook in European law and several articles that have been published in legal journals. These articles have concerned financial markets, competition law, taxation, enforcement of Community law and European federalism compared to U.S. Constitutional law.

My recent research that has resulted in the manuscript for a book under publication. The study concerns state measures distorting free competition in the EC. As far as known, these issues have not been dealt with earlier from a general perspective. There are several books on public undertakings, state subsidies and the 3, 5 and 85 pre-emption test (the Midcal test in the U.S.). However, I think that hereto related issues have to be dealt with also from a general perspective, especially in the EMU-perspective which may result in a lower degree of tolerance towards local regulations in the Member States. Subsequently, I will start a new research programme concerning tax harmonisation in the common market and the EMU-perspective. I will provide you with more information concerning this project later.

Finally, I am also a guest lecturer at the Universities of Groningen, Lyon, Stockholm and Turin.

    Consultancy

I have experience of both legal practise and public administration beside my academic actitvities. I have been practising business law and European law during a number of years which you can see in editions of Martindale & Hubbel from 1991 to 1996. I was an appointed expert in the Swedish Ministry of Foreign Affairs, Department of Trade between 1989 and 1991. Before that I worked in the Institute of European Market Law in Copenhagen which at that time was managed by prof. dr. Hjalte Rasmussen (now professor of European law at the University of Copenhagen).

I have mostly worked with European law, competition law, technology transfer, mergers and acquisitions, arbitration and litigation before the European Court of Justice. I have acted as legal representative in several significant cases before the Court in Luxemburg. I have also represented several parties concerning notifications and complaints before the European Commission.

I have therefore a reasonably broad experience from mainly the European industry, since I have been working with major clients of which several are noted on stock exchanges and internationally renowned law firms. I think that the combination between research/teaching and consultancy is ideal for maintaining a high level of know-how in order to optimimize the contributions to my clients. Nowadays, I do much work for law firms as a sub-contractor. In practice I am an advisor to advisors and consultants.
